Federal Judge Mandates Release of Kilmar Abrego Garcia from Immigration Detention

A federal judge has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment is without legal authority.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her ruling.

The case stems from a mistaken removal to El Salvador in March, which US authorities later acknowledged was an error. Following his return to the United States to answer alien smuggling charges, he was held in federal custody.

In her decision, the court noted that the authorities lacks a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

Context of the Legal Challenge

The legal challenge center on disputed claims. While the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently denies this allegation.

He has also entered a not guilty plea to the conspiracy charges, which are part of a separate criminal case in Tennessee.

Terms of Release

The judge, who was hearing his challenge to removal in a Maryland district court, ruled that he must now comply with the terms of his bond from custody in Tennessee. This decision effectively transfers his monitoring to the Tennessee court.
